There is no wash sale rule on gains- just take them if you need to offset your losses. You don't have to wait more than one second to re-enter your trade. Did I misunderstand your post? Sorry in advance if I did. Actually now that I re-read it, I understand your dilemma - hmmmm Yes, you misread on your first pass. I have realized gains and now have some positions with unrealized losses. I would be surprised if there aren't a myriad of others with the same dilemma.

Last month of the year. Oh, what to do what to do. Realized gains YTD that are screaming to be partially offset with some unrealized losses due to the recent swoon from $705. Wash sale rule not in play for me currently. Have to see what transpires during the month, but if one waits too long to realize losses, the 30 day point to re-enter to avoid the wash sale rule will be too late in January to reap the rewards of any pre-earnings upward move should there be one. Thus, the plan would be to do next week at the risk of any early December upward move. Anyone else pondering in a similar fashion? I should add that the YTD gains I have are split between long term and short term. I will only be considering washing short term losses up to the amount of my short term gains as I will gladly pay this year's long term capital gains tax. The dilemma between cutting my 2012 tax bill versus potentially missing out on an upward AAPL move still stands, however.

To confirm, if I close out a January 13 640/650 position at a loss on Monday I can buy back the same positions on Wednesday, same strikes, get a new basis and take the loss against 2012 gains? I believe if you want to avoid the wash sale rule you have to rebuy a position with a different strike and expiration. I called TDA's tax department and that's what they advised.

Why Ipad mini the 7th in China if soon orders will not be filled in US for holiday season? Shouldn't US be a priority? What is the negative or Chinese rollout 2 weeks later than currently scheduled? Just doesnt make sense to me.

Well it sounds like you are just debating at what point in time to take those losses. Do you think you are lucky/good enough to time it just right? And worse, if the politicians move the markets will your losses become greater or lessen - it is such a crap shoot from now to year-end on this with so much NOT having to do with AAPL itself. Of course, you could be somewhat prudent and take some now with only half your position -- then you will be guaranteed to always be at least half right regardless of direction!

While a different strike and expiration would be most prudent, even the same expiration but off by a few strikes should be plenty. I'm much more bothered by the offsetting straddle rules than the wash rules, since with options the wash rules seem to be easy to not trigger. Whereas they seem to often trigger the offsetting rules.

With Apple in so many places in the world why should the US get first priority? And where are our devices being manufactured? Besides, as just noted on this thread, any mini ordered by 12/5 gets delivered before Christmas. I think it's TC's magic touch at work here.

I figure there will be enough mini's in stores for the last minute shoppers and the overlap from Dec. 5 on line orders in the US and the Dec. 7 China release seems a prudent strategy. I guess we'll find out if this worked to everyone's advantage in Jan/April.

Alabama vs. Georgia was quite the game - what a grind! Glad to see Alabama win but Notre Dame will surely be the underdog going into that one! Yikes! What to do - what to do - I like Notre Dame but I also like Saban...hmmm....will still have to root for ND!

Thought the Dogs would win for a while. Bama was the better team and will represent the SEC nicely. That was a dominating offensive line performance by Alabama. That was one physical football game. It is good they have several weeks to recover, especially for that refrigerator they call a nose guard. Rick, I hope Johnny football wins, he sure deserves it. An incredibly gifted player.
