Found this on seeking alpha - but haven't seen anywhere else yet: seekingalpha.com/article/1228301-judge-upholds-virnetx-jury-verdict-against-apple-for-368m?source=google_news"On Tuesday evening, February 26, 2013 with regards to Case No. 6:10-CV-417 VirnetX (VHC), Plaintiff vs. Apple (AAPL), Defendant a memorandum opinion and order was delivered by Judge Leonard Davis. The follow key factors were released and confirmed by the company this evening: The jury verdict was upheld for $368,160,000 in favor of VirnetX for infringing on their US Patents which describe a method of transparently creating a virtual private network ("VPN") between a client computer and a target computer. Other patents disclose a secure domain name service. Both products developed by VirnetX establishes secure communications.. 2) Apple's request for a new trial as a Matter Of Law under Rule 50(b) was DENIED 3) A daily award to VirnetX in the amount of $330,211/day will be paid to VirnetX immediately until everything regarding the royalties are rectified and all details are settled between each of the two parties 4) The kicker here for investors to know is that: The parties are ordered to get together between themselves for "royalty" mediation settlement for future use of the technologies in dispute or the judge has stated that he will make a ruling if not reached within 45 days. In Summary: The news as reported on Tuesday, February 26, 2013 by the Eastern District of Texas - Tyler Division was very positive for VirnetX. The judge came off as very measured and did not come over the top in his decision this evening. VirnetX did not win an injunction per (Docket No 621), but judge Davis is making it perfectly clear to the parties that he wants them to work out a royalty settlement through forced mediation. Penalties are calculating now against Apple for any further delays. What the judge is doing here today is not a usual practice. This ruling, in my opinion, would greatly reduce any chances for an appeals process. Next steps: Get ready for a positive outcome in the days/weeks to follow with Apple and then prepare for the VirnetX trial against Cisco (CSCO) in March."

Anyone know offhand how this ruling will effect earnings if apple is required to pay this quarter? As in, would they have allowed for any payment already in previous quarters? Or will the whole total come out of this quarters earnings?
As is we are looking at a decent hit to EPS of almost 50 cents

Apple might as well just buy VHC after this verdict. Especially if the royalty rate is going to be 1% of device revenue.

Amusing tidbit this morning as Doug Kass is out on Twitter and Stocktwits saying that the AAPL split rumors were coming from numerous sources. Meanwhile someone replied to him saying: YOU were the one spreading those rumors yesterday on both Twitter and Stocktwits in a show of pure manipulation! When will these guys and others like him be castigated / fined / and yes, jailed by the SEC? SEC is so useless. All they need to do is review what he did yesterday and reconcile how he traded against it. It truly is criminal.

Meanwhile someone replied to him saying: YOU were the one spreading those rumors yesterday on both Twitter and Stocktwits in a show of pure manipulation! When will these guys and others like him be castigated / fined / and yes, jailed by the SEC? SEC is so useless. All they need to do is review what he did yesterday and reconcile how he traded against it. It truly is criminal. He repeated them, then once he'd made some money, claimed they were baseless. That's manipulation pure and simple.

"Eastern District of Texas" courts ars notorious for ruling for the plaintiffs. Any lawyers here have comments. Edit: the author of the article is long VirnetX. This might cause some bias in his comment about chances for appeal.

If Kass is going to manipulate AAPL, then I'm going to jump on his coattails. Sure, he gets the benefit of buying/selling immediately before he says anything. But if you're keen enough, you can catch most of the wave he creates.

Not sure who commissioned or commissions this report but it certainly puts iOS as the dominant and growing mobile platform in the enterprise. Most notably Android devices are basically flat. People in the enterprise are finding new uses/apps for mobile across industries, not just limited to business and financial. (Interesting how far entertainment is down the list. No problem but I was a little surprised to see it so far down. Perhaps it is because the report looks at % activations as a whole vs within industry). My wife and I attended our first Apple Shareholders Meeting in 2012 and the experience made us look forward to future meetings. After the last several months of AAPL declines and the Einhorn ruckus, I've been curious to see how our experience will be different this year. I'll soon know.

The Wallet app is designed to let users store things such as event tickets, boarding passes, membership cards, and coupons in one central location, much in the same fashion as Apple's Passbook app for iOS. (...) The company showed off a few features of the new app during its developer keynote, and it's quite clear that Samsung took its design inspiration for Wallet from Apple's Passbook (even down to the icon that Samsung used)."

The Samsung / Google fans are arguing that Google has had Wallet for years. And indeed they have, they have never had Passbook, however, some sneaky naming strategy there from Samsung to try and cover their assets.
