Good morning everyone. AAPL and the major indices are UNDECIDED this morning, flipping between red and green. Will we see $130 print today? In the news: Apple sued after allegedly poaching battery scientists, engineers. Stories at Electronista, WSJ [$], and Reuters. Ireland's new data protection watchdog seeks the power to levy fines of up to 5 percent of a firm's global revenue for breaches of the EU's proposed new unified data privacy law. Story at Reuters. CNBC reports Motorola boss calls Apple prices ‘outrageous’. When Lenova/Motorola can deliver comparable value for half the price then Apple may have a problem. Until then... yawn. Is it enough to pull us that far down? I like to think not. Two trading days left. Much can change. Unfortunately, there is not much pulling us the other way.

During a panel discussion on Tuesday, Prat Vemana, vice president of mobile commerce at Staples, said that Apple Pay users account for 30 percent of purchases made through the retailer's iOS app, reports FierceMobileIT. I'm amazed, but not surprised, that this story is being spun as ApplePay is dead in most of the media outlets, especially when you consider the stuff Artman found above.

I haven't seen anything that refers to Pay being dead ... each time TC speaks about it it sounds like they have signed on a million more companies ... and the federal gov't I believe. That being said, I don't see why he needs to be secretive about this specific product. I think that periodically announcing successes here would be inspiring to stock holders and help stock price. IMHO

IMHO Ah, you're looking at reality, I was mentioning how this was reported by the usual suspects. Looks like there's still some of that Samsung marketing money swooshing around.

AAPL is too strong to succumb to OPEX. This week's price action suggests the expectation that OPEX was going to deliver a buying opportunity that never came. The train is moving and seats are limited.
To the TA soothsayers: What happened to the prediction that AAPL was going to step on the escalator going down once at $126?

Marcellus - I am not good at TA or am I a soothsayer (of course - except when I tell my kids to take a sweater and umbrella because it looks chilly and those clouds look ominous - and they don't - and come back sneezing and drenched...but I digress). When the stock gets to certain targets that have been projected then there is a reassessment. As an example, if we are bumping up against resistance then we know what that resistance level is and we see if it is piercing it with gusto or bumping up against it and floundering. Then one can reassess whether we go for an extension which is the next Fibonacci level or go down to that support level at which point it gets assessed again. Not incorporating any fundamentals is also silly but I think I explained it somewhat here now I believe how TA used...at least by me.
