It’s lame that Biden didn’t veto this to give Apple some time to sort this out. Clearly there is some merit to apples claims and massimo generally is known to be a bit of a patent troll despite some of their actual past innovation.
What’s next? The existing retail channel will get cleared pretty quickly by speculators or actual customers. Then the grey market importing begins? People who want the 9 or ultra 2 are not going to be satisfied with the SE. I expect there will be inflated prices on the secondary market as grey market stuff from CDN and elsewhere comes in. Either way, Apple will still sell a lot of them, just maybe not through official channels as they have been, but the (watch) market will find a way, it always does.

What would be great is if Apple were to win the patent infringement lawsuit and then counter sue for loss of revenue and damages. It would be poetic.

I'm not sure I'd consider Masimo to be patent trolls. If you look at what they do, they're primarily in the medical device space. You know the thing they put on your finger to test your O2 level? that's them. I think in this case, they may have a valid claim. They also got in to some consumer audio products. Not sure how it fits with the main business though. Brands like Denon, Marantz, Polk and Boston Acoustics

Much more likely, Apple (their attorneys) will find Apple patents that Massimo is infringing upon and then bring a patent infringement suit. Usually those suits are settled by reciprocal licensing agreements.

Apple already has an outstanding countersuit against Masimo. While massimo did some work in the pulse oximeter space in the somewhat distant past , nothing recently have they innovated on , just been trolling enforcement of old stuff. They are still pissed apple hired away some of their employees.
Apple clearly has the stronger hand In this case, (or at least they think they do), otherwise, they would’ve already settled. Money doesn’t mean anything to them, but being right and setting a precedent certainly does.
Most of massimos claims were found invalid and 11/12 jurors were for Apple in the mistrial. Apples real innovation is a single ended pulse oximieter , meaning it’s reflective not transmissive. Massimo doesn’t want just cash they want co-ownership of apples IP in this space. I see that as a nonstarter for Apple, as it should be.
Massimo’s audio brands are just red herring rubbish that they bought through takeovers. They’ve got no real IP in that space, and most of those brands are mid fi at best.
Unfortunately, as much as this is just noise and a drop in the bucket in the big picture of revenue, it will continue to dominate the Apple news space until it’s resolved. And likely have negative effect as a result. At least until vision Pro starts shipping and attention is shifted elsewhere.
