OS stuff is even harder to protect than hardware. Seems like a pretty fluffy statement to make IMO.

The issue as I see it is that ITC has gone against the rest of the world and imposed an import ban on a Standards Encumbered Patent. This is ridiculous.

So in 60 days, Apple will no longer be able to import the iPhone 4 and iPad 2 3G? It won't be much longer than that before the iPhone 4 is gone anyways, and how many iPad 2 3G's does Apple still sell? This ruling seems pretty meaningless to me, at least to Apple earnings in the next few quarters.

"The Boogeyman Effect" is what we'll have to measure, as unquantifiable as it may be.
I'd prefer the White House, whatever you might think of the administration, just do the right thing, dispense of the 60 days it has to "look this over" and veto this SEP abuse-friendly decision yesterday. That would pretty much nullify the ITC's antics now and going forward, and this is a slam dunk obvious thing. But I'm not holding my breath. I mean hey, the DOJ is hellbent on bringing Apple to justice for...e-book pricing.

The dilemma becomes - is this a gift for those of us that want to buy cheaper....or does it hurt the technical picture for the future? This seems like a gift to buy before WWDC. What a coincidence for the OEs.

This is actually a great turn of events provided it doesn't cause serious trouble down the road. This is the first real measuring stick to see if sentiment has swung.

It's great because it's a measuring opportunity or it's great IF AAPL weathers this tempest in a teapot decently enough? Or both?

It's great because it's a measuring opportunity or it's great IF AAPL weathers this tempest in a teapot decently enough? Or both? Both. The more information we get, the better. Obviously I'm hoping for us to weather the storm here, and I think we will. We may still end up marginally down. But a story like this three months ago would have tanked us like there's no tomorrow.

Let's sluff it off and get a move up before WWDC. The leaks are starting and the prognostications are getting more interesting. I would still like to see 560 on Friday (or higher) after we let the EOs steal some shares at the open tomorrow.
Chas, good to see you!

You mean 460. At this point, I'm micro bearish just in terms of gut sentiment. I want to see AAPL make some move over 450, stat!

This is interesting. Apple Poised for Hiring Spree in Silicon"Apple expects to expand its Silicon Valley workforce by nearly 50 percent during the next three years, signaling the company's faith in its ability to keep coming up with hit products like the iPhone and iPad. The projections detailed in a report released Tuesday envision Apple hiring 7,400 more workers at its Cupertino, Calif., headquarters between now and the planned completion of a new office complex in 2016."

I question the second half of the second sentence - Apple really hasn't been in reinvent or die mode for years - but a company as big as Apple is and looking to grow could stand to hire a few thousand more quality people.

I think the ITC decision is too little too late to help Samsung or hurt Apple. It was splitting the baby.
Now the exciting thing to talk about is the theme of WWDC. Where a whole new world is developing....
That my friends is a prerequisite to something big. TC talked about new products in fall. I now think that WWDC will set the tone and lay a foundation for some exciting new services and products to be released this fall. But it will be bigger then that because each new product and service will build upon a whole new world where magic happens.

My left field prediction for WWDC - Apple introduces a streaming game service (think onLive) capable of streaming high quality graphically intensive games to the Apple TV, iOS devices & Macs from apples servers.
It means apple can keep selling the current generation Apple TV for $99 with its underpowered SoC and no storage, and offer users the highest quality games - as good or better than the PS4 or xBox one, and constantly improving all the time.

I'm not sure about OnLive. Or even streaming games.
Resolution and bandwidth issues aside, why pay a monthly fee for a not-your-game on a remote server when you can get a top-tier title like Infinity Blade Whatever for less than $10, and a lot of other fun games for less than that? Just Add Multiplayer™!
Apple may not be sure if it wants to turn Apple TV into a set-top box with apps, but with as many sold as it has so far, maybe there's no rush.
As far as upgrades, the A6 will make its way to Apple TV eventually. It's just a question of when, and whether it'll be in single-core or dual-core form. I'd also add that Apple has TONS of iOS gaming options already (hundreds of millions), and there's no need to enrich the Apple TV niche right now when resources are already being deployed to push graphics power forward in the iPhone, iPad and iPod touch. And given the overlap between iOS device owners and Apple TV owners, it makes more sense for Apple TV to be a companion/video mirroring device, or at least something that complements, rather than being "redundant".

I want stuff like Apple TV and iRadio to be quick asides, not time filler, if they even show up at WWDC in the first place.

I didn't really realise it before, but something just clicked in my head regarding all of Tim Cooks emphasis on hardware, software and SERVICES that he mentioned a few times during the D11 interview. By services I presumed he was talking about iCloud, but perhaps there is a new strategy to vastly expand apple services.
Possibly:
- iRadio subscription/ad supported service - iGaming streaming service - Netflix style movie/TV streaming service
Personally I'm not really that excited about a subscription music service, but I would not hesitate to pay $15 a month or more each for a subscription gaming & movie/TV services on my Apple TV.

burgess -
Just my opinion, but I really, REALLY don't think you should get your hopes up on subscription gaming. Particularly since games are so cheap, and since iOS has full multiplayer support + matchmaking (assuming Game Center's core functions stay intact). For $200 a year you can have 10-20 Infinity Blade-class games or 30-40 "smaller" but no less fun ones, and still have room for an in-app purchase here and there. That should be plenty for most gamers.
Now _app rental_ (which I'm pretty sure you're not talking about) could be an interesting idea as far as developers getting their apps out there and having another source of revenue, but I'll leave that to Apple and others to figure out.
Far as services, Apple is "way behind" on services, but it's an integrated hardware/software company first, and $150B+ dollars per year can't be that wrong. Now, Apple DID have a very forward-thinking CEO who saw iCloud long before many of us (so he grokked the importance of services), and Tim is certainly carrying the torch, but there really isn't a "reach services parity with Android/Google OR DIE" kinda urgency at work here. Ecosystem + OS is more important than "isn't it awesome that X company stalks me and force-feeds me 'relevant/sponsored/suggested results' everywhere I go". I'd prefer Apple get the services platform more "right" than "fast". Maps and Siri, after all.

Agreed. Services has been the underlying theme that I've picked up on in the recent interviews and conf call. I don't recall hearing anything about those being delayed until the fall or early 2014 as specifically mentioned for hardware updates. My thoughts. Subscription radio service is inevitable. Advertising revs from this could be surprising. I could see opening up ATV SDK to facilitate more gaming using ipad/phone/touch as controllers. Already available with Real Racing 3 and probably some others. Monetizing Game Center would be a nice bonus. Apps for video content on ATV would be great. I enjoy Formula 1, Moto GP and ALMS but the races are almost never on network or basic cable channels in the US. I'd happily buy an app to watch these races/season al a carte similar to the MLB service on ATV. Same goes for HBO. Would happily pay for HBOgo to watch Vice and Game of Thrones too, but these few programs make it hard to justify premium cable. Passbook enhancements could bring mobile payments to the forefront of services.

Samsung's unbelievable cheek:
“We believe the I.T.C.’s final determination has confirmed Apple’s history of free-riding on Samsung’s technological innovations,” Samsung said in a statement.
