January ADP report on its way at 8:15 am .... TWTR reports after the bell .... GOOG settles with EU in Antitrust Case (guess Schmidt earned his keep) ... Overnight Nikkei was up a little over 1% ... Europe a bit mixed ... In the US we're down about 8 points on the S&P as of right now but we know all can change prior to the opening. AAPL a bit red (-1.29) this morning. I still don't understand why AAPL didn't post a Superbowl Commercial. Their Mac turns 30 Ad could have been shown. It runs about 1.5 minutes and I believe the rate was $4 million per 30 seconds - you think they could have afforded it? Don't get it. Anyway, not seeing much in the news on AAPL other than continued conversation about potential features on the potential iWatch and the hiring (as was posted yesterday) of Roy J.E.M. Rayman (gotta love what his middle initials spell out - sort of). People debating whether the iWatch will be more about healthcare versus health clubs (daily exercise). No one knows...all speculation. And I wonder what on earth ever happened to SJ's inference about having "cracked the code" on television to Isaacson?
Anyway - onto markets - AAPL has held up pretty well during this downturn although to be frank, we've had our own little personalized downturn last week. Let's see what the market gods bring us today. One last thing....patents trial between Samsung and Apple begins on March 31st for those of you who care and like following that side of it.

Need to admit that Zuckerberg is a genius. For FB's tenth anniversary they compiled a short film of numerous photos you've shared through the years in a beautifully done montage. I woke up today to people sharing their films and everyone is fully engaged. I've seen friends on that I haven't seen on in a while....everyone viewing their montages to beautiful music in the background. To be honest, mine brought tears to my eyes. Brilliant move.

Interesting. I was also thinking that, as beautiful as Apple's recent ads have been, they are more nostalgic in tone than I would like to see. Anheuser-Busch and McDonalds both went through periods when their ads became intensely nostalgic and feel-good, and both were at times when those companies were coasting. I would prefer to see edgy ads that do NOT appeal to someone like me (older and softer).

DJ is reporting that Apple is being sued for $2.1B in Germany over cell phone patents: This patent troll is trying to assert a FRAND/SEP patent that applies to LTE and other standards essential patents. Isn't it about time that such suits were declared frivolous on their faces, and the plaintiffs sanctioned? I suspect that the German courts will throw this out, but wouldn't it be great if Apple could then sue them for defamation and put them out of business entirely? Can they shift the tone away from the nicey nicey nicey stuff to something a bit more.... cool and clever?

Remember that AAPL goes ex-dividend tomorrow. From the Apple Investor Relations site: "Apple’s Board of Directors has declared a cash dividend of $3.05 per share of the Company’s common stock. The dividend is payable on February 13, 2014, to shareholders of record as of the close of business on February 10, 2014."
